What is A.R.S. § 33-1818 and how does it affect our community?
A.R.S. § 33-1818 was amended effective October 30, 2023, affecting planned communities that regulate
public roadways. The law requires planned communities with pre-2015 deed restrictions governing
public roadways to hold a membership vote prior to June 30, 2025, to determine whether the Members
wish to authorize the Association to continue regulating public roadways within the community.
Why does this apply to Gladden Farms?
1) Our Declaration was recorded in 2003 (prior to January 1, 2015)
2) Our Declaration regulates public roadways, including:
• Parking restrictions in designated areas
• Requirements for enclosed garage parking
When will the vote take place?
The vote is planned for Spring 2025. Detailed information regarding the voting period and ballots will be
provided and mailed to all homeowners once the date is finalized and draws closer. The vote is required to be completed by June 30, 2025.
How many votes need to be recorded for the vote to pass?
The quorum for the vote is 20%, which amounts to approximately 640 returned ballots. If the majority of the 640 vote "Yes," the parking restrictions will remain as they currently are in perpetuity.
What does a "YES" vote mean and what happens if the vote passes?
The Association maintains its current authority to regulate public roadways within the community and
street parking restrictions remain in place.
What does a "NO" vote mean and what happens if the vote fails?
• The Association loses all authority to regulate public roadways.
• The decision is permanent and cannot be reversed by future votes.
• It's uncertain whether the Town would implement or enforce parking regulations.
What is the current authority to regulate public roadways?
• The Association has full authority to enforce all roadway regulations through June 30, 2025, per
Exhibit “C” Section (g) of the Declaration.
• All current parking restrictions currently remain active and enforceable.
What is the Association's position?
The Association recommends voting in favor of retaining regulatory authority:
• Preserves our community's residential character
• Protects public safety, including emergency vehicle access
• Maintains adequate navigation space on public roadways
Is this decision permanent?
Yes. If the Association loses authority over public roadways, A.R.S. § 33-1818 does not allow future votes
to restore.
What happens if quorum isn't reached?
This would then be a discussion of the board of directors, as the process of conducting an additional vote would result in an additional expense.
Does Gladden Farms have designated overflow parking? Are we allowed to park in or around the playgrounds and parks in our neighborhood?
Gladden Farms does not have designated overflow parking, and parking at or in the playgrounds/parks in our community is not permitted. These are not designated parking areas, and our park hours conclude at 9:00 PM. The designated parking areas are within the garage and driveway of the home.
Will a “NO” vote lower our assessment amount?
No; a “NO” vote will not result in a reduction of assessment fees. The annual expense for parking enforcement is a very small fragment of the overall Association operating budget. Therefore, there would not be a reduction in the assessments if the vote were to fail ("no" vote).
Will other property restrictions be affected by this vote?
No. This vote only concerns the Association’s authority over public roadways. Other property
restrictions will remain unchanged.
Does the Town of Marana currently patrol the streets in Gladden Farms for parking violations?
The Town of Marana does not perform regular inspections for violations. There are currently two (2) Code Enforcement Officers for the Town. Issues must be reported by filing a complaint directly with the Town.
What are the guidelines for extending my driveway?
Modifications for extending your driveway must be submitted for approval prior to work beginning. Materials are typically pavers or concrete. The extensions on either side may be to the width of the garage.
Who is eligible to vote?
1) Only property owners may vote
2) One vote per lot/household, regardless of:
• Number of owners on the deed
• Number of residents residing in the home
3) For lots with multiple property owners, those owners must share one vote.
